Sebelumnya beberapa orang guru besar lalu pakar hukum di dalam berubah-ubah kota memberikan sikap terkait perkara Mardani H Maming.<\/p>\n<p>Tim Anotasi Fakultas Hukum Unpad mempresentasikan kajian mengenai perkara yang dimaksud menimpa Mardani H Maming ke Auditorium Rencana Pascasarjana, Fakultas Hukum, Universitas Padajaran, Bandung, hari terakhir pekan (18\/10\/2024). Para akademisi yang tersebut mempresentasikan anotasi itu adalah Sigid Suseno, Somawijaya, Elis Rusmiati, Erika Magdalena Chandra, Budi Arta Atmaja, juga Septo Ahady Atmasasmita.                   <\/strong><\/p>\n<p>Akademisi Hukum Unpad Somawijaya mengatakan, penerapan Pasal 12 huruf b UU PTPK terhadap Mardani H. Maming pada menghasilkan serta menerbitkan Surat Keputusan Kepala Kabupaten Tanah Bumbu Nomor 296 Tahun 2011 tentang Persetujuan Pelimpahan Izin Usaha Pertambangan Operasi Produksi Batubara PT Bangun Karya Pratama Lestari untuk PT Prolindo Cipta Nusantara tidaklah tepat serta merupakan kesalahan yang digunakan kritis dari hakim.<\/p>\n<p>\u201cSelain itu, perbuatan Terdakwa Mardani H. Maming tak memenuhi unsur-unsur perbuatan pidana sebagaimana dirumuskan pada Pasal 12 huruf b UU PTPK berdasarkan ketentuan minimal 2 alat bukti pada fakta pada persidangan,\u201d katanya.<\/p>\n<p>Para Akademisi Hukum Unpad menilai, perbuatan menimbulkan serta menerbitkan Surat Keputusan Kepala Daerah Tanah Bumbu Nomor 296 Tahun 2011 tidak ada melanggar SOP Penerbitan Keputusan Bupati. Juga tidaklah bertentangan dengan ketentuan Pasal 93 UU Nomor 4 Tahun 2009 tentang Pertambangan Mineral kemudian Batubara. <\/p>\n<p>\u201cBerdasarkan ketentuan Pasal 8 ayat (1) huruf b dan juga huruf c UU No. 4 Tahun 2009 tentang Mineral serta Batubara, eksekutif Daerah pada pengelolaan pertambangan mineral lalu batu bara berwenang untuk memberikan IUP,\u201d ujarnya.<\/p>\n<p>Poin selanjutnya adalah perbuatan Mardani H. Maming \u201cmenerima hadiah\u201d merupakan uang juga barang belaka didasarkan pada asumsi atau bukti petunjuk yang dimaksud tak miliki kekuatan pembuktian lalu tak didasarkan minimal 2 alat bukti di fakta ke persidangan.<\/p>\n<p>\u201cDalam fakta di dalam persidangan tak ada hubungan kausal antara perbuatan \u201cmenerima hadiah\u201d dengan perbuatan \u201cmembuat kemudian menerbitkan Surat Keputusan Pimpinan Daerah Tanah Bumbu Nomor 296 Tahun 2011,\u201d tandasnya.<\/p>\n<p>Senada dengan itu, Elis Rusmiati mengkaji penetapan pidana tambahan terdiri dari uang alternatif sebesar Rp110 miliar. Menurutnya, hal ini bertentangan dengan maksud ketentuan Pasal 18 UU PTPK yaitu sebagai perwakilan kerugian negara, sedangkan aktivitas pidana pada ketentuan Pasal 12 huruf b UU PTPK tak berkaitan dengan kerugian negara.                   <\/p>\n<p>\u201cNah kenapa pada perkara ini kami tim notasi itu menganggap bahwa pertimbangan hakim dalam di menjatuhkan putusan pidana tambahan berbentuk pidana uang substitusi itu adalah tidak ada tepat atau tak sebagaimana mestinya, lantaran pada faktanya uang sekitar Rp110 miliar tidak ada sanggup dikualifikasikan sebagai uang kerugian negara.
